IMPORTANT – READ CAREFULLY BEFORE YOUR PURCHASE: By opening the sealed packets(s), installing, activating OR exercising your rights to use the SOFTWARE (as may be provided for below), you agree to be bound by these terms and conditions and the EULA (End User License Agreement). If you do not agree with the terms and conditions of this Agreement do not purchase, open or activate the software, and promptly return this package to the place from which you obtained it for a full refund. If the software license has found to be activated, you forfeit your right to receive a refund. For the limited warranty pertaining to your jurisdiction, please refer to the warranty booklet, if any, included in this package.
SINGLE COMPUTER USE. CD ROM or downloadable media products permit you to use one copy of the specified version of this SOFTWARE product as identified above (“SOFTWARE”) on a single computer. Once you have run that portion of the SOFTWARE called the “setup” or “install” program on your computer, you may use the SOFTWARE on a different computer only if you first delete the files installed by the setup program from the first computer (if any) and follow the license transfer process as outlined on our Technical Support page on our web site. You may not copy the SOFTWARE from the program disks to a computer hard disk or other permanent electronic storage device (except as it occurs when you run the setup/install program or use other features of the SOFTWARE on your single computer).
USE OF COPYRIGHTED MATERIALS (with DietMaster Pro version Only). This license agreement permits you to distribute royalty free any printable documents that are copyrighted under Lifestyles Technologies, Inc. This provision does not apply to R.D. Meal Plan Templates or DietMaster 2000 or any other software designated for home or personal use.
PREMIUM CARE SUPPORT PROGRAM (with DietMaster Pro version Only). Each single license is bound by the terms and conditions of the Premium Care Support Program (PCP). It requires an annual re-activation of the Product Key, which is assigned to each license. The annual fee will be $59.95. Failure to re-activate your Product Key will cause this license to expire, meaning the software will not operate. With the re-activation of the product key you will also receive one year of free upgrades, free technical support, and free periodic staff training.
UPGRADES. If the SOFTWARE is an upgrade from a previous version, you are granted a single license to both copies, and you may not separately transfer the prior version(s) except as a one time permanent transfer to another user of the latest upgrade and all prior versions.
COPYRIGHT. The SOFTWARE, including any images, photographs, animations, video, audio, music and text incorporated in the SOFTWARE, is owned by Lifestyles Technologies, Inc. or its suppliers and is protected by United States copyright laws and international treaty provisions. You may not copy any of the printed materials accompanying the SOFTWARE.
OTHER RESTRICTIONS. You may not rent or lease the SOFTWARE. You may not reverse engineer, decompile, or disassemble the SOFTWARE. The SOFTWARE license is not transferable.
LIMITED WARRANTY. Lifestyles Technologies, Inc. warrants that (a) the SOFTWARE will perform without defects when installed on a clean Windows or Mac Operating system installation, in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt (date of purchase), and any hardware accompanying the SOFTWARE will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of receipt (date of purchase). Any implied warranties on the SOFTWARE and hardware are limited to ninety (90) days and one (1) year, respectively. Some states/jurisdictions so not allow limitations on duration of an implied warranty, so the above limitation may not apply to you.
CUSTOMER REMEDIES. SOFTWARE purchases are not refundable. All sales are final. Lifestyles Technologies, Inc. and its suppliers entire liability and your exclusive remedy shall be, at Lifestyles Technologies, Inc.’s option, to repair or replace the SOFTWARE or hardware that does not meet Lifestyles Technologies, Inc.’s Limited Warranty. This warranty is void if failure of the SOFTWARE or hardware has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE or hardware will be warranted for the remainder of the original warranty period or thirty days, whichever is longer.
SOFTWARE purchases are not refundable. All sales are final. Lifestyles Technologies, Inc. and its supplier’s entire liability and your exclusive remedy shall be, at Lifestyles Technologies, Inc.’s option, to repair or replace the SOFTWARE or hardware that does not meet Lifestyles Technologies, Inc.’s Limited Warranty. This warranty is void if failure of the SOFTWARE or hardware has resulted from accident, abuse, or misapplication. If you do not agree with these terms and conditions, do not purchase or activate the software, if you purchase has already been processed, and promptly return this package to the place from which you obtained it for a full refund. Special terms and conditions may apply depending on SOFTWARE product type. If the SOFTWARE license has found to be activated or used in any way, you forfeit your right to receive a refund.
INTERNATIONAL SHIPPING: Lifestyles Technologies is not responsible for any additional customs fees, tariffs or taxes arising from processing and acceptance into foreign countries outside of the United States.
RETURNS. All returns must include an RMA number (Return Materials Authorization). To obtain an RMA number please call our offices and speak to a customer service representative. Additional instructions will be provided. Any materials received without an RMA number will be either returned to sender. All international returns without an RMA number will be discarded.
